The amparo forces Grupo Mexico to respect the strike at the San Martin Sombrerete mine, Zacatecas. The First Collegiate Court on Labor Matters granted an amparo to the National Union of Mining, Metallurgical, Steel and Similar Workers of the Mexican Republic (SNTMMSSRM) that heads Napoleon Gomez Urrutia, which forces the company Mexico Group to respect the strike at the San Martin Sombrerete mine, Zacatecas.

The resolution of the magistrates orders the Federal Conciliation and Arbitration Board to nullify the award of April 2 of this year, which resulted from the labor dispute between the union and the company headed by German Larrea.

In addition, that in the replacement of the procedure, determine again the conformation of the list of employees with the right to vote based on the persons that appear as workers dating from August 14, 2013.

The board shall determine that the copy of the award issued in labor file number 1791/2013, of the index of the Special Board Number Nineteen of the Federal Conciliation and Arbitration, which dates from January 28, 2014, has no probative value; and, in resolving the dispute, apply the content of the first paragraph of Article 902 of the Federal Labor Law, determining what is applicable by law.

In July of this year, members of section 201 of the Mining Union held a commemorative assembly in their union auditorium, 12 years after the strike at the San Martin mine, in the municipality of Sombrerete.

In this assembly they reiterated to the federal government the requirement that “the esophals with which Grupo Mexico illegally operates that mine be expelled from the deposit, after breaking the strike in August 2018”; however, in June of this year the Third District Court in Labor granted them an amparo to reactivate the strike.
